Kissimmee Rental Company vacation homes

The Kissimmee Rental Company, its owners, agents, and managers (collectively referred to below as ‘The Company’), agree to rent a short term rental to the guest (hereinafter referred to as ‘You’, ‘The Guest’, or ‘Guests’) subject to the terms and conditions as set out below.

I. Reservation Details, Deposit, and Payment
Once You have placed Your reservation, a Rental Agreement and Registration Form will be sent to You either via e-mail or fax. The signed Rental Agreement and Registration Form must be filled out, signed, and returned to The Company within 48 hours of making the reservation. 

A $150.00 non-refundable deposit, which will be applied to the total price of Your rental, is also due within 48 hours of making the reservation (if paid by money order, payment must be received within 4 days).  You will be contacted within 24 hours to confirm that Your required deposit was processed.

Payment for the remaining balance is due 30 days (60 days for 7 bedroom homes) prior to arrival and also becomes non-refundable at that point.   If You have reserved a property within 30 days of Your arrival date, the total reservation amount is due at the time of booking.  The final payment will be billed to Your credit card on file unless other payment arrangements have been made.

The Company gladly accepts credit cards (Visa, MasterCard, American Express, and Discover), money order, or cashier’s check.  However, if The Guest wishes to pay by money order of check, We still require a valid credit card number to be held on file in case of any damages to the property.  This credit card number must be written where required on the registration form.

Your signature (hand or electronic) on the Rental Agreement, or payment of money to The Company, or taking possession of the property, is evidence of Your acceptance of our terms and conditions.

II. Cancellation Policy
If You should need to cancel 31 or more days (61 or more days for 7 bedroom homes) prior to arrival, You will not be charged for the remaining balance.  If You cancel 30 or fewer days (60 or fewer days for 7 bedroom homes) prior to Your arrival, You will be charged the FULL RENTAL amount.  All cancellation must be in writing and mailed to The Kissimmee Rental Company 7512 Dr. Phillips Blvd. Suite 50 PMB 400 Orlando FL 32819.  When You make a reservation, We strongly suggest purchasing Travel Insurance.

III. Substitutions
We reserve the right to substitute comparable accommodations without liability, should a property become unavailable.  In the event of a property becoming unavailable, We will contact You to offer comparable accommodation.  If comparable accommodations are not available, The Guest will have the option of selecting from available properties at the published rate or receiving a complete refund of monies paid.

IV. Damage to Homes
Damage caused to the homes by The Guest will be the responsibility of the guests. This includes, but is not limited to, damage to carpet and damage to furnishings and upholstery. The Guest is also responsible for ensuring the homes are left in an acceptable standard upon check out. If any damage occurs to the property or any item(s) are stolen, the credit card provided on Your registration form will be debited for the amount of damage/theft. You will receive a copy of the receipt as well as an itemized statement of damages within 2 weeks of Your departure.

V. Cleaning
While guests are not expected to clean the homes, it is a term of Your reservation that You agree to leave the home(s) in a tidy and acceptable standard. An unacceptable standard is defined a leaving the home measurably different from check in. This includes, but is not limited to, moving furniture, leaving behind large quantities of personal possessions or trash, or not cleaning up vomit or other bodily fluids.

If a house sustains damage and / or is not left in an acceptable standard upon checkout, as defined by The Company, the Guest is legally responsible to refund The Company for the expense in rectifying the problems. It is a term and condition of Your reservation that You agree for Your credit card to be debited for this amount. Upon request, The Company will furnish The Guest with an invoice(s) for work done.

VI. Check In and Check Out
Check in time is after 4:00 PM. The Guest may check with The Company to see if the home is available early. However, an early check-in is NOT guaranteed.

Check out is by 10am at the latest. If You fail to check out by 10am, The Company reserves the right to charge Your credit card an additional night's stay. Towards the end of Your stay You may request late check out, however We do not guarantee this will be possible.
Upon check out, the keys must be returned to the original point of collection (in most cases this will be the lockbox at the property). If the keys are not returned, We reserve the right to charge the credit card on file $25.00 to replace the missing keys.

VII. Minimum Stay Length
We require a minimum 3 night stay on all properties except during peak season. 
During peak season, which includes the 2 weeks around Easter and the 2 weeks around Christmas, We have a 5 night minimum stay for all properties.

VIII. Property Occupancy Limits
Our properties have the following maximum occupancy limits (unless otherwise noted in a home’s details).  Maximum occupancy limits includes infants and children.

2 Bedroom Condo - 6 people
3 Bedroom House or Condo - 8 people
4 Bedroom House or Condo - 10 people
5 Bedroom House - 12 people
6 Bedroom House - 14 people
7 Bedroom House - 16 people

Please note that these are not our restrictions, they are state law.  The authorities police this law and that they have the powers to spot-check homes at any time for infringement. In the event of higher occupancy than that permitted, You will be required to vacate the property immediately. If this occurs, there will be no refund of the rental payment.

IX. Minimum Age
We require that there is at least one person over the age of 21 (except married couples) in each house reserved. Guests found breaking this condition will be required to leave the property and no refund of any sort will be given.

X. Swimming Pool
If property has a private swimming pool, The Company does not accept any liability for injury, however caused, as a result of the use of the pool. Guests are specifically requested not to allow unsupervised children to use the pool. Local laws apply.

XI. Pool Heating
We ask You to please read these details carefully if You are considering booking a home with a heated pool as there are specific guidelines. Pool heating must be booked in advance of arrival to be guaranteed – as not all the properties have a pool heater.

Pool heat is an option with our Vacation Rental Homes and can be added to Your reservation for and additional $25/night plus tax ($35/night plus tax for homes with gas pool heaters).  Charges commence from the day the pool heat is turned on.  However, please note that pool heaters can take up to 24 hours to heat from the time it is turned on.  Pool heaters will generally heat the pools to around 85 degrees Fahrenheit.  However, in order for the heater to work effectively, it is very important that You place the pool cover on the pool when You are not using it (especially overnight).  In addition, if the air temperature lowers to 55 degrees or less, although the heaters operate for longer hours than in warmer weather, they will not be very effective and the water temperature will not reach a comfortable temperature.  We regret that in these circumstances a refund of part or all of the monies paid is not possible.  Pool heaters have electrical components, which can sometimes malfunction.  Please call the rental office as soon as possible if You do not believe Your pool/spa is heating properly.  If it is found that the pool heater is not working properly, any days that the heater is verified inoperative will be credited.  No additional compensation will be given to the guest.  The Company will do everything in its power to rectify and problems with malfunctioning equipment as quickly as possible. 

XII. No Smoking, Pets, or Firearms
All of our rentals are non-smoking properties. If You smoke we request that You do so outside. If You do smoke inside the property You will be charged $150.00 to have the house shampooed and deodorized.

Please note that pets are not permitted in our homes unless prior arrangements have been made and the pet deposit is received. If it is discovered that a pet has been in a home, there is an automatic minimum charge of $150.00 to cover the cost of professionally cleaning all carpets and upholstery. There is an additional charge should a pest control company's services be required. You will also be asked to leave the home, forfeiting Your stay and any payments or deposits made.

Firearms of any kind are prohibited in our vacation homes. If a firearm is discovered in Your home, You will be asked to leave, forfeiting Your stay and any payments or deposits made.

XIII. Trash
Trash collection days will be posted within the home. Trash must be placed in the bins provided and must be taken to the end of the driveway by 7:00 am the morning of collection. If there is excess of trash on departure due to not putting trash out there will be a $50 pick up charge.

XIV. Telephone Service
Each home does come equipped with telephone service. In most cases, unless otherwise noted, the phone service has been limited to the local calling area. For long distance calls, a credit card or phone card (which can be purchased at any local gas station or supermarket) will be required.

XV. Consumable Items
In making Your reservation with The Company, You understand that Your vacation will be self catering in nature. We do not provide consumables items. We provide one roll of toilet paper and one bar of soap per bathroom at the beginning of Your vacation. These will not be renewed. It is the responsibility of the guest to provide items such as washing up liquid, dishwasher powder (see folder in vacation home), washing machine powder, toilet paper, soap, shampoo etc.

XVI. Power, Water, Phone, & Cable Outages
We occasionally experience outages that are beyond our control.  We report outages as each occurs.  No refund will be given for any outages.  

XVII. Construction Work
Guests recognize that Central Florida and, in particular, the Disney World area is growing and expanding quickly. As a result there is a lot of construction work in progress. Guests accept as a term of their reservation that construction work may be present near their vacation homes. If this occurs, guests may ask that they be moved to a new vacation home. However, this is only a request and can not be guaranteed.

XVIII. Insects
Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. The home is treated regularly as part of a pest control program. We advise You to keep all windows and external doors closed whenever possible; not only will this help keep bugs from the property but it will also enable the air conditioning unit to function more efficiently.

XIX. Travel and Health Insurance
Guests are advised to have appropriate travel/medical insurance in force for the period of rental. All matters arising with regard to loss or injury should be directed to the respective insurance company.

XX. Personal Safety
The Company cannot accept any liability for Your personal safety during Your residency at the rental property. Guests are reminded to exercise care as to personal safety of themselves and all party members. Whenever possible, valuables should be left secure and out of sight. We are not responsible for accidents or injury to guest or for loss of money or valuables of any kind.

XXI. Special Conditions
The Company will not be liable for any loss or delay occasioned by any of the following; strikes, riots, political unrest, war or the threat of war, terrorist activities, industrial disputes, fire, flood, technical/weather problems to transport, aircraft, closure of airports, or any other event beyond The Company’s control.

XXII. Responsible Party
The person who makes the reservation and whose name is on the confirmation documents is the lead name. The lead name is solely responsible for the reservation. This includes but is not limited to responsibility for damage to homes, theft, and making payments. We will only take instructions relating to the reservation from the lead name. Please note that the lead name will be responsible for payment for damage etc, even if they did not cause it, if it was caused by a member or their party / group.

XXIII. If We Cancel Your Reservation
In the event of circumstances beyond our control requiring us to cancel a reservation, i.e. acts of God, civil disturbances, riots, flood, drought, fire and legislation, only repayment in full of any monies paid in respect of the reservation will be made. We will do everything in our power to find suitable alternative accommodation, however We can accept no liability whatsoever in respect of any loss or damage sustained by the hirer in these circumstances.

XXIV. Maintenance Issues
Every effort is made to have Your rental property clean and all equipment and furnishings in good working order.  However, as with all properties, our homes encounter unexpected maintenance problems from time to time. If this occurs We will do everything within our powers to fix the problem within twenty-four hours of it being reported.  However, it is a term of Your reservation that You understand that not all issues can be solved on an immediate basis.  For example, if vendors and/or contractors outside of The Company have to be called in for cable, electrical, plumbing, warranty service, etc., The Company must schedule through said vendor according to their availability, which may not always be same day service.  In addition, same day service may be delayed if repairs require ordering of a part, which may not be in stock.  These issues are not to be considered a reason for refund of said unit.

XXV. Other
We reserve the right to refund deposits, refuse rentals, or discontinue occupancy if, in our opinion, a renter is detrimental to the property.  Any reservation obtained under false pretense will be subject to forfeiture.  The Company or its representatives may enter the Property at any time, without notice, for the purposes of protection and/or maintenance of the Property.  Wherever possible, The Company will provide notice to The Guest prior to such entrance.
